Should PARWA Office Bearers not be prosecuted for breaking the law?

I have written number of posts on this blog. I have also spoken to PARWA Office Bearers. I have also written number of letters to them, but they continued breaking the law. They even rejected my nomination for the post of President PARWA by breaking the law. PARWA has no authority to charge parking/maintenance fee from residents for parking their cars, charging fee from advertisers and also for charging rent for parks for holding functions. In fact MCD has no such scheme where RWAs can be authorized to charge these fees.

This PARWA EC is the result of an illegal election where Election Officer conspired with outgoing President and Gen Secretary to ensure their re-election. Nomination of Block Representatives is illegal as they are required to be elected not nominated as per PARWA Bye-laws. Similarly nomination of Joint Secretary and filling the vacancy of treasurer are illegal.

President PARWA is so arrogant that he is not ready to listen to the reason. His arrogance has forced me to approach MCD through RTI Act to know the law and whether PARWA is acting within the law or breaking it. I have received the reply from MCD and it is clear that PARWA Office Bearers are guilty of breaking the law. See for yourself. Click on the images.

सावधानी में ही सुरक्षा है

पुरानी कहावत है पर हर समय लागू होती है. कल रात गेट नंबर १ के बाहर नाले पर पार्क्ड कारों में से एक के शीशे खोलने की कोशिश की गई. गेट पर मौजूद चौकीदार के अनुसार वह चार आदमी थे. उसने आवाज लगाईं. उसी समय अपार्टमेन्ट के एक निवासी अपनी कार से वहां पहुंचे और उनकी तरफ दौड़े. इस से घबरा कर वह आदमी भाग गए.

घटना तो घट गई. ईश्वर की कृपा से कोई नुकसान भी नहीं हुआ. पर इस से सबक सीखना जरूरी है. क्या पार्वा कार्यकारिणी इस से सबक सीखेगी?

रात में गेट नंबर १ पर केवल एक
चौकीदार होता है. बाकी चौकीदार अन्दर गश्त लगाते रहते हैं. कम से कम एक चौकीदार और होना चाहिए. दो चौकीदार हमेशा गेट पर रहें. बैसे भी पार्वा कार मालिकों से शुल्क लेती है कारों की सुरक्षा प्रदान करने के लिए. यह शुल्क एक चौकीदार को, जो हमेशा इन कारों के पास रहे, नियुक्त करने में प्रयोग किया जाना चाहिए. अब तक ऐसा क्यों नहीं किया गया?

एक और बात का ध्यान रखना भी आवश्यक है.
चौकीदार रात में अपार्टमेन्ट और उसके निवासियों को सुरक्षा प्रदान करते हैं. चौकीदारों की सुरक्षा की जिम्मेदारी निवासियों की प्रतिनिधि संस्था पार्वा की है. क्या पार्वा यह जिम्मेदारी पूरी तरह निभा रही है? मुझे ऐसा नहीं लगता. पार्वा कार्यकारिणी तुरंत इस बारे में विचार करके उपयुक्त निर्णय ले. सावधानी वरतना जरूरी है. सावधानी में ही सुरक्षा है.

Why President PARWA does not reply to letters written to him by residents?

Term of present PARWA EC is coming to close. During this period, I have written few letters to President PARWA but none of them have been replied.

When I handed over my letter dated 09.03.20 to the President on the subject of payment of minimum wages to PARWA employees, I was assured that this issue will be discussed in annual GBM. But he has not included this item in the agenda of GBM recently circulated. I wrote another letter proposing three points for discussion in annual GBM:
1. Paying minimum wages and providing other facilities to PARWA employees as per law.
2. Restricting tenure of PARWA officer bearers to two terms of one year each.
3. Is PARWA EC authorized by law to collect car parking fee from residents?

But till date I have not received any communication from him. The coutesy demands that I should be informed whether PARWA EC has decided to include these points in the agenda of annual GBM or decided against it. If EC has rejected my proposal then the reasons for rejection should also be communicated to me.

Similarly I had submitted a detailed proposal for regulating construction activity in Pragati Apartments from security point of view. This has also not been replied so far.

Now, what a PARWA member is expected to do under such circumstances? Should I bring it to the notice of Registrar of Cooperative Societies, and request him to send his representative to attend annual GBM to ensure that issues proposed by me are discussed in the GBM?

Any suggestions dear residents?
