Illegal RWA EC Election 2011 - two more illegalities

Some time back I have uploaded a post - Illegal PARWA EC Election 2011 - in which I pointed out many illegalities committed in the election. Two more illegalities have come to my notice. These illegalities relate to Composition of EC, Bye-law 8.2.

a) Post of Joint Secretary - As per the bye-law the post of Joint Secreatry will be filled from the six elected EC members. Today I was surprised to learn that Shri T D Soni of Flat 255 has been nominated as Joint secretary. As per the result declared by EO no body has been elected from the block of flats 233 - 300. How can then Shri Soni can be made Joint Secreatry? He has not been elected as EC member. His nomination as Joint Secretary is illegal and in violation of PARWA Bye-laws.

In addition, Shri Soni was part of the team which conducted the election. He has even been designated (though illegally) as Election Officer by Shri Aggarwal who illegally designated himself as Chief Election Officer. It has been alleged that there was a conspiracy between outgoing President and Gen Secretary and the Election Officer and his team. Is this nomination of Shri Soni is a reward to him given by Chadha Malik & Co for his role ensuring that Chadha and Malik are re-elected? This is immoral and unethical. No body has heard that a member of election commission is nominated to the house after elections are over. This proves the allegation.

b) EC member fron block of flats 301 - 356 - This is second surprise. Shri Kanwar Jit Singh of Flat 305 has been nominated as EC member. As per the result declared by EO no body has been elected from the block of flats 301 - 356. there is no provision in Bye-laws for EC to nominate block representatives. These positions can only be filled through election. Nomination of Shri Kanwar Jit Singh as EC momber is illegal and in violation of Bye-laws.

In addition, Shri Kanwar jit Singh has filed his nomination as block representative. His nomination was rejected by the EO without assigning any reason in writing. But after the election same Shri Kanwar Jit Singh was nominated as EC member. How a person whose nomination was rejected became eligible for the same post after election? This is unheard of. This is illegal and in violation of Bye-laws.

This EC election is really a blot on the fair name of PARWA. If Chadha Malik & Co have any shame left they should immediately resign. An emergency meeting of GB should be called to dissolve this illegally elected EC and fresh elections should be ordered.

Though illegal, PARWA EC should get ready for monsoon

I hope you have seen the public notice issued by MCD about the complaint redressal system to deal with the problems in monsoon season. If not then click on the image.

Has PARWA EC prepared itself for coming monsoon and how to address the problems of water logging, fallen trees, manhole covers, sanitation, repair of potholes or any other problem? I am sure they have not even thought of it. PARWA EC should immediately hold an emergency meeting and discuss this issue.

Block representatives should be specifically asked to keep an eye on monsoon related problems in their respective blocks. A coordinator should be appointed to coordinate with civic agencies. Whenever a complaint is received from a resident or a block representative, he should immediately report to concerned civil agency at the phone number given in the public notice. A complaint number will be given to him by the agency, and he should closely monitor the actions being taken by the civic agency to effectively solve the problem.

Residents should be informed about name and phone number of the coordinator.

Though illegal, PARWA EC should do its duty

Sometime back I wrote a post about massive power tariff hike. CLICK to read it if you have not read it so far.

Has Chadha Malik & Co. filed objections/comments on the proposals of DISCOMS asking for massive hike in power tariff not only for 2011-2012 but also for recovery of dues from consumers for 2008-2009 and 2009-2010 after increasing the tariff for these two previous years? I am sure they have not done so. The massive power hike is going to hit hard. They have failed to do their duty.

Now DERC has given them another chance. The last date for submitting objection/comments has been extended up to 01.07.2011. Now they should immediately file objections/comments and attend the hearings as per programme (see the image) to present views of the residents of Pragati Apartments.

I know that the new EC has been elected illegally but they are occupying the PARWA Office and so have a duty towards the residents of Pragati Apartments.

केंद्र सरकार ने राष्ट्रीय स्वास्थ्य बीमा योजना के अंतर्गत एक फैसला किया है जिस के अन्दर घरों में काम करने वाली बाइयों का ३०००० रूपए का वार्षिक बीमा कराया जायेगा. इस बीमे के लिए वार्षिक प्रीमियम ७५० रूपए होगा और यह प्रीमियम केंद्र सरकार देगी. इस योजना में हर बाई को पंजीकरण करना होगा. इसके लिए उन्हें २ प्रमाणपत्रों की जरूरत होगी. यह प्रमाणपत्र घर के मालिक, रेजिडेंट्स वेलफेयर असोसिएशन, बाईयों की यूनियन या पुलिस द्वारा दिया जा सकता है. पूरे विवरण के लिए साथ की इमेज पर क्लिक करें.

Unite and fight against massive power tariff hike

I am sure residents of Pragati Apartments are aware that the threat of a massive power tariff hike is looming large. Stakeholders and various consumer activists have been preparing to fight it out in the public hearing scheduled to be held in this month. I am not sure whether PARWA has submitted any objections to DERC.

The massive power hike is going to affect every one of us. The private Discoms are asking for significant hike in tariff for 2011-12 with BSES Yamuna is asking for a 85 % hike, BSES Rajdhani a 67 % hike, and NDPL a 50% hike.

Illegal PARWA EC will not do anything. The residents will have to act independent of PARWA EC. A group should be formed and a plan should be prepared to fight out this unjust hike.

Illegal PARWA Election 2011

I have been discussing with legal experts the illegalities committed by the Election Officer (EO) and outgoing President and General Secreatry, Mr Chadha and Mr Malik in PARWA Election 2011. There are many ileegalities:
a) Elections were held under modified bye-laws which were not approved by the competent authority under the Act.
b) Many provisions of the bye-laws were violated.
c) as per his own admission, EO has not read the bye-laws. How could he conduct the election when he was not aware of the election law?
d) EO conspired with outgoing President and General Secreatry, Mr Chadha and Mr Malik in rejecting nominations of some contestents.
e) As outgoing President and General Secreatry, Mr Chadha and Mr Malik were themselves contesting the election, there was clear conflict of interest. As EO was unaware of bye-laws, Mr Chadha and Mr Malik became the de-facto Election Officer.
f) The list of members, eligible to contest and vote in the election, was not displayed by outgoing President and General Secreatry, Mr Chadha and Mr Malik.
g) List of residents who filed their nomination was not displayed by EO.
h) List of residents whose nomination was rejected by EO was not displayed by EO.
i) Objections filed by a contestent were not appropriately addressed by EO and were rejected without applying his mind and against the principles of natural justice.
f) Objections filed by a contestent were not appropriately addressed by outgoing EC and were rejected without applying i mintsd and against the principles of natural justice.
g) Residents, whose nominations were rejected by EO, were not informed of rejection and reasons thereof, not giving them any chance to contest the grounds of rejection. This is against the principles of natural justice.
h) EO was found by residents having meeting and partying with outgoing President and General Secreatry, Mr Chadha and Mr Malik during time slot fixed for filing nominations. This is against the principles of natural justic and also shows that EO was in conpiracy with them.

There may be many other violations which I am studying. Legal experts have advised some actions which also I am studying and will take as advised.

This illegal election is a blot on the fair name of PARWA and Pragati Apartments. It is the duty of every resident to protest these illegalities and get this illegal election set aside.

Bhagidari - RTI about PARWA EC performance

CLICK to read my earlier post on the performance of PARWA EC in Bhagidari initiative. PARWA EC could not get even a single project under this scheme. What they got is a piece of paper which they falsely claim is a certificate that PARWA is the best RWA in West Delhi.

As illegally forced in PARWA EC, Mr Chadha and Mr Malik have refused to give any information about their performance in Bhagidari, I intend to file an application with Delhi Govt under RTI Act. The quaestion are as follows:

"Smt Sheila Dikshit, Chief Minister of Delhi has awarded a Certificate of Recognition to Pragati Apartments Residents Welfare Association (PARWA), Paschim Vihar for appreciable contribution to Bhagidari initiative in 2010. Relating to this, please provide following information under RTI Act, 2005:

a) Give details of all the awards given to RWAs under Bhagidari initiative.

b) Is cash also given to RWAs along with some awards? Give details of such awards and amount of cash award.

c) Provide a list of RWAs who have been given awards in 2010 along with details of contribution made by these RWAs to Bhagidari initiative including by PARWA.

d) What are the criteria for selection of RWAs for giving awards? Give full details.

e) What is the procedure followed for selecting RWAs for these awards? Give full details.

f) Is there a committee which selects the RWAs for giving awards? Give details of such committee and its members.

g) Do the members of above committee visit the colony of RWAs and what aspects of RWAs functioning are checked/verified?

h) On what dates the committee visited Pragati Apartments and what were its findings. Give all details.

i) Who represented PARWA during the visits of committee members to Pragati Apartments and during other interactions?

j) Can a RWA after getting the Certificate of Recognition claim that it the best RWA in the area?

k) Is it checked and verified that RWA follows the laws of the land, such as, paying minimum wages and overtime at prescribed rates to its employees? Was it checked in case of PARWA?"

Who represents PARWA in RWC?

As new PARWA EC is illegal, its occupation of the office of PARWA is illegal. I am taking appropriate steps to get this election declared null & void. Till such time members of PARWA will have to deal with this illegal EC.

MCD has constituted RWCs to give more and better say to RWAs in the development of their residential complexes and surrounding areas. For this purpose PARWA was to nominate a resident to this area's RWC. This illegal EC has not informed PARWA members about this.

As a member of PARWA I demand to know:
a) Name of the resident who has been nominated to RWC.
b) How the name of this PARWA representative was decided?
c) Has any meeting of RWC has been held so far?
d) What issues were projected in RWC by PARWA representative?
e) Why PARWA members have not been informed about this?

Mr Chadha and Mr Malik, the illegal occupiers of the positions of President and Gen Secretary, have been behaving in an arrogant manner. Working of PARWA EC is not transparent. If they have any self-respect then they should immediately step down and let fresh elections be called by PARWA GB.

Paying subscription fee to PARWA is mandatory


A Delhi Trial Court has ruled that owners or occupents of a flat are bound to pay theembership fee to RWA of the colony to fund its various welfare activities and services. For details, click on image.



PARWA should bring this court order to the notice of those residents who have not paid the subscription.

Why I did not speak in last AGBM?

A member has commented in C-box:
"member: SC Gupta never opens his mouth in GB or anywhere, he only writes untrue thing in web and hide."

I would say both Yes and No.

In last few meetings of GB, I have spoken but it was of no use. There was no discipline. There used be no respect for chair. People used to shout at each other, even coming to exchanging blows with each other. These were only group fights, trying to score over other group. No proper discussion, no proper announcement of decisions on issues, no proper recording of decision in the minutes.

I wanted to speak in last AGBM. There was an important issue of illegal EC elections. I had given a representation to Mr Chadha, asking EC to hold its emergency meeting and invite me to present my views in person on the illegality in election process. I had also asked EC to discuss its decision in AGBM. Mr Chadha did not reply to my representation, neither it was discussed by EC, nor was I invited to EC meeting. He also did not put up my representation before GB.

I could have raised this issue in AGBM but was discouraged by many factors. Only 14% of members were present. The strong presence of ladies baffled me. I was given a hint by some residents that I will not be allowed to speak, that I will be shouted down. I never believed that Mr Chadha will go to such extent to defend his illegal actions. I did not want a situation in AGBM which will further erode the good name of PARWA.

I am all for discussion but a sincere and to-the-point discussion. I am ready for any debate at any time with Mr Chadha and/or any other member(s) of this illegal PARWA EC. Let them come forward and have an open debate in Central Park.

Now coming to writing untrue things and hide - I have never written anything untrue. What I have written in available on the blog. Let anybody answer that and prove that it is untrue. And who is hiding? This member has not commented under his real name. This is my blog and everybody knows it. I am not hiding from anybody.

Illegal PARWA EC is against children

Have you seen the minutes of AGBM held on May 1, 2011? The great Mr Malik had recorded the following as a decision taken in this meeting:
"5. Children should not be allowed to play in the park."

First it is a wrong recording. No such decision was taken. The issue was no doubt raised and some discussion took place, but it was inconclusive. A member even said that Delhi High Court has given a decision that children will play in the parks. How PARWA GM can decide against the decision of Delhi High Court.? I am not a legal person but will it not be treated as a Contempt of Court?

I want to ask PARWA one question. Where children will play if they are not allowed to play in the parks? Has PARWA made some alternative arrangement for this? The oldies in PARWA are much beyond the age of playing, but for children playing is very important. How can they be stopped from playng in the parks, and that too after the High Court decision?

Only 14% members attended the AGBM and only a few of them might be against children playing in parks. How can "Children should not be allowed to play in the park" be recorded as a majority decision of PARWA? This is wrong. The minutes should be amended and re-circulated. Mr Malik and Mr Chadha can not wrongly draft the decisions of PARWA.

Moreover this PARWA EC has been declared elected by Election Officer in an illegal manner. Its members have no moral, legal and ethical right to work as EC members . Both Chadha and Malik are vulnerable to a conflict of interest in dealing with election issues as they themselves were contesting the election of President and General Secretary. Misusing their position they did not display the list of those members who were eleigble and not-eleigible for contesting and voting in the election. By hiding this information, they illegally ensured their election to new EC by advising election officer to reject some nominations including that of Mr Gupta for the post of President. Election officer had informed that he did not read the Bye-Laws and was found having a meeting with both Mr Chadha and Mr Malik.

This illegal election is a blot on the fair name of PARWA. To restore PARWA's fair name this election should be cancelled and fresh election should be ordered.

Bhagidari - Projects Under "My Delhi I Care"

I was reading about Bhagidari scheme of Dekhi Govt relating to West Delhi. I found a list of completed projects under "My Delhi I care". CLICK to Read.

You will notice that out of 8 projects 5 belong to Rama Park (C-Block) RWA. These are:

1. Provision of Iron Gate and sinage indicating name of colony/Association at entrance, C-Block Rama Park
2. Provision for recreation centre for Senior Citizen
3. Provision for main hole cover
4. Provision for Iron Gate adn sign ages
5. Provision for construction of entry gate at three locations and sign board

The total cost is about 5.5 lakhs.

What is the performance of PARWA EC in this respect - a certificate printed on a piece of paper?

क्या दान की रकम आपस में बाँट ली?

रविवार, १ मई २०११ को हुई पार्वा आम सभा की बैठक में श्री धवन ने मनोरंजन कक्ष के लिए ११०० रुपये दान में देने की घोषणा की थी. इस बारे में श्री मलिक द्वारा तैयार किये गए मिनिट्स में कोई जिक्र नहीं है. क्यों ???

क्या धवन साहब इस दान को देने से मुकर गए या फिर मलिक साहब ने यह धन आपस में बाँट लिया?

हिन्दू धर्म के अनुसार एक बार व्यक्ति जो संकल्प कर लेता है उस से मुकर नहीं सकता. धवन साहब ने ११०० रुपये देने धवन साहब ने ११०० रुपये देने का संकल्प किया था, अब यह धन उनका नहीं रहा. उन्हें यह धन पार्वा के पास जमा कर देना चाहिए. मनोरंजन कक्ष में जब उस की आवश्यकता पड़े, पार्वा इस धन को खर्च करे.

मलिक साहब को आम सभा की मीटिंग के मिनिट्स में संशोधन इशू करना चाहए.

History repeated itself

Annual GB meeting of PARWA revived the memories of my school days when we were taught in history class about the starategies adopted by Mughal invadors in the war against Indian kings. Armies of both sides would be facing each other in the battlefield. Mughal invadors will form lines of women and children in the front. Hindu kings and their forces would hesitate to attack them and this will affect their fighting ability. Mughal invadors will win with ease.

My Parents have taught me - yatra naryastu pujyante ramante tatr devta, meaning where women are respected, Gods reside. In Hindi, जहाँ नारी का सम्मान होता है वहां देवता निवास करते हैं. I wanted to raise the issue of illegality in election process but the presence of women in the front line forced me to keep quiet. I lost that round of battle against dirty group politcs of outgoing plus incoming President of PARWA. The history repeated itself in Pragati Apartments.

Such low grade politics in the name of serving the residents.

Declare the election null & void

Election to PARWA EC 2011-2012 should be declared null & void.

The election conducted by Dr V P Aggarwal, Election Officer (EO), is a blot on the name of PARWA.

Election Officer worked as AGENT of Mr Chadha, outgoing President, and again a candidate for the post of President in this election.

The election had not been fair and free.

Election Officer violated PARWA Bye-Laws, did not follow his own circular and took decisions in violation of Principles of Natural Justice.

This election has a distinction where the election officer has not even read PARWA Bye-Laws. He has accepted his appointment as Election Officer to conduct election as per the provisions of the Bye-Laws but he has not even thought it necessary to read the Bye-Laws. As he was not aware of the provisions of PARWA Bye-Laws, he could not and did not apply his mind but choose to follow the advice given to him by the outgoing President, Mr Chadha.

As Mr Chadha was himself a contestent for the post of President PARWA, there was a clear conflict of interest. Mr Chadha misused this official position and gave such advice which will ensure his unopposed election as President PARWA. EO worked as Mr Chadha's agent and ensured it. He rejected the nomination of Mr Gupta who had also filed nomination for the post of President PARWA.

EO gave no reasons for rejecting the nomination of Mr Gupta. When Mr Gupta asked EO in writing then EO gave him a reason under which Mr Gupta's nomination can not be rejected. Mr Gupta submitted a representation to PARWA EC, the body which has appointed the EO, asking EC to reconsider the appointment of EO in view of the above and some other points, but Mr Chadha again misused his position and took no action on this representation. He did not call the emergency meeting of EC and also did not discuss this issue in the GB meeting. He ignored the representation as any re-consideration of EO's appointment would have spoiled his chances of again becoming President PARWA.

As PARWA Bye-Laws have no system of Grievance Redressal against the illegal decisions of PARWA President and EO and their dictatorial attitude, there is no option left except approaching the Registrar of Societies for declaring this election null & void, order fresh elections and conduct the election under the supervision of an officer of the office of Registrar of Societies.

A detailed complaint is being drafted. Any inputs for this complaint are welcome.

The story of broken promises

Broken promises, वादा खिलाफी, वचन भंग करना.

Sant Tulsidas has written - रघुकुल रीति सदा चली आई, प्राण जाएँ पर वचन न जाई.

Some people will say that Sant Tulsidas has written it about Raghukul, the family of Lord Ram. Human beings, like us, can not be expected to follow such hugh standards. To some extent I will also agree with this, but people should at least try to keep their promiss. They should not break promises just like that.

Last year Mr Chadha made two promises. He had filed nomination for the post of President. I had also filed the nomination for this post. Mr Sachdeva and Mr Dhawan came to my house and told me that I should withdraw my nomination as Mr Chadha wanted to be President for one term. To justify their submission they talked very high of Mr Chadha. I did not agree. Then Mr Chadha paid a visit to me. He also said the same thing that he wanted one term as president. I did not agree to withdraw and said that let there be election as it is the correct democratic process. After some discussion he said that he did not want election and if there was election he would withdraw. I said that it was OK with me. He then promised to withdraw. He failed to keep his promise.

After date of withdrawal, there were two contestents, me and Mr Chadha. Now elction was a must. Mr Chadha had however kept insisting that there should be no election. It was beyond my understanding that why he was bent upon breaking the law. One day he told me that he wanted to become President for one term. As there was going to be election, he told me that he was under lot of stress. He even told me that he was suffering from blood pressure and might have a problem. I was shocked. It was emotional blackmail. The pressure was too much. I gave in and told him that I would come with him to all the residents and request them that I had withdrawn in favour of Mr Chadha and they may vote for him. I don't know how but he pursuaded the Election Officer and both of them said they would cancel the voting. I told them that it would be a violation of law, but they went ahead and announced the result that Mr Chadha was elected unopposed. Both of them told me that no body will raise any objection. Mr Chadha promised me that it was for one term only and in next election he would himself propose my nomination. He did not keep this promise also. He not only failed to keep his promise but he went ahead to conspire with this Eloection Officer also and got my nomination rejected.

WHY PEOPLE BREAK PROMISES, AND THAT TOO FOR STICKING TO THE POST OF PRESIDENT OF PARWA?

PARWA GB Meeting May 2011

Today PARWA had its General Body meeting. This was the last meeting of outgoing PARWA EC. The time fixed for the meeting was 10.00 AM. At 10.05 AM, four residents were present. From PARWA EC side - President, General Secretary and a Block Representative. From GB members - me. President adjourned the meeting to again start at 1030 AM. Meeting finally started after 1030 AM with seven members (out of 12) from EC and about 16 members from GB. Nine members of PARWA EC did not reach the meeting place at 10.00 AM, and 5 were altogether absent from the meeting. It is to be noted that this was the time decided by the EC itself. One notable absent EC member, Mr Vats has again filled up his nomination for another one year term. Are there any benchmarks to be met by EC members in respect of punctuality and regularity? This was first point which should have been discussed in the GB meeting.

There are 365 flats in Pragati Apartments. About 50 flats were represented in the GB meeting. What does it mean? Only about 17% members took decisions which will affect remaining 83%. In addition, these are only majority decisions. All present members did not support these decisions. Can we call the decisions taken at GB meeting representing the interest of all the members of PARWA? A big NO.

Now why all the members do not attend these GB meetings? What are the reasons that a big majority remains aloof from the working of PARWA? This was second point which should have been discussed in the GB meeting.

Now whose job is to make PARWA a body where all members attend its meetings? Is it the job of President and other officers bearers/members of PARWA EC? Is PARWA EC a representative body of PARWA GB or is it only a caretaker sort of arrangement to take care of PARWA day-to-day matters? This was third point which should have been discussed in the GB meeting.

There was no decorum in the meeting. There was cross-talk not only amongst GB memebrs but also on the dias. Quality of sound system was very bad. Nothing was heard clearly. You can see this in videos, where visuals are recorded but no audio. There was lot of noise created by fans. In one case you will see a security guard almost snatching the mike from a speaking EC member. In one case, a EC member is seen gesticulating at GB members.

At one point, President commented that people come to GB meeting to only do खिंचाई of EC. Some GB members objected to it. They said that if this was the attitude of EC then what was the use of calling GB meeting and having discussions. Then it was the turn of the Treasurer to call GB members "rats". A GB member objected to it, but other members tried to pass it on as humour. Decorum was the fourth point which should have been discussed in the GB meeting.

President made a very important observation that if he puts PARWA to a loss of Rs One Lakh, then what action can be taken against him. PARWA Bye-LAWS have not provided for any grievance redressal mechanism. GB members have complaints against EC members but there is no forum where they can file their complaints and seek redressal of their grievances. This was fifth point which should have been discussed in the GB meeting.

A point was raised about inconvenience being caused to residents having flats facing Central Park by functions being held in the park. The issue was discussed but no clear decision was taken.

Another point was raised about the quality of security being provided. Some discussion took place but no clear decision was taken.

There are many such issues. I will talk about them later. I want to see how General Secretary records the discussions and decisions. There was no clear announcement by President about the decision taken after discussion on many issues.

Steamrolling the Election Process by Election Officer

In my last post I have uploaded two letters written to election Officer, Dr V P Aggarwal bringing certain issues to his notice and requested his comments on those issues (my letter dated 26.11.2011). As he has rejected my nomination for the post of President, PARWA, I had requested him to inform me the basis on which he has rejected my nomination and the documents on which he has based his decision. The second letter was delivered to him personally at 0745 PM on 27.04.2011. His reply to my letter was delivered to me by a security guard at 0910 AM on 28.04.2011.

You can read his reply by clicking on the image. You will note that he has taken only 45 minutes to reply to my letter. This shows his insincerity and lack of respect for PARWA Bye-Laws and a member of PARWA. He has earlier told me and some other members of PARWA that he has not read the Bye-Laws. Now he simply gives reference to a Bye-Law and says that all my charges are strongly denied and disposed off.

Now let us see what is Bye-Law No. 5? This Bye-Law is about Cessation, Appeal and Re-admission of PRAWA Membership. It no where says anything about rejection of the nomination of S C Gupta for the post of President PARWA. In fact Election to PARWA EC is governed by the provisions in Bye-Law 8.4.

I am surprised at this offensive and illegal attitude of Dr V P Aggarwal, who has been appointed as Election Officer by outgoing PARWA EC to conduct a free, fair and just election. He has taken a wrong decision to reject my nomination. He is duty bound to inform me the exact reason(s) of the rejection. He did not inform me about it before releasing the list of contestents whose nominations have been accepted by him. I could have given suitable explanations to his objections to my nomination. Now also he is not providing me any details of the reasons of rejecting my nomination. This is nothing but a dictatotial attitude and a wilful denial of free, fair and just election process. He seems to be having a hurt ego. He is trying to steamroll the election process and forcing me to accept his unjust illegal decision to reject my nomination. He has become a liability on the free, fair and just election process of PARWA EC. PARWA EC should immediately re-consider its decision appointing him as Election Officer. He has failed to conduct the election in a free, fair and just manner.

Election Officer vitiates election process

Read my two letters written to Election Officer:

Dear Sir,

Through this letter I wish to bring to your notice some disturbing developments in the process of Election of PARWA EC for the term 2011- 2012.

1. As per PARWA Bye-Law 8.4, the EC or GB will appoint an Election Officer from apartment owners. Further, the Election Officer can take help of any of the GB members/s for conducting the election. The circular issued by you on 10.04.11 has been signed as Chief Election Officer. I am of the view that the designation as given in PARWA Bye-Laws should have been used. A different designation may be termed as violation of the relevant Bye-Laws.
2. Copy of the above circular has been marked to the President and General Secretary of PARWA to display duly signed and certified list of eligible members of PARWA by 20th April 2011. This list has not been displayed so far.
3. You have taken help of Shri S P Suri and Shri T D Soni for conducting the election. While this is in accordance with provisions of Bye-Laws, designating them as Election Officer is in violation of Bye-Laws as Bye-Laws do not permit a multi-member body to conduct election. Also these residents do not have any official role in the election process and can not sign any official papers.
4. A resident, who has submitted his nomination paper, has informed me that when he went to your office on 24.04.11 at 0745 PM, he found number of people sitting with you in a meeting and also a party was on. Notable amongst them are Mr Chadha and Mr Malik, outgoing President and General Secretary of PARWA. This is clearly illegal and unethical.
5. The time slot of 0700 – 0800 PM has been reserved by you for receiving nomination papers. Allowing other contestants and their supporters to sit with you during this period and having a meeting with them puts a big question mark on the impartiality of election process. Election Officer is an independent functionary and such interactions with outgoing President and General Secretary will naturally be viewed with suspicion that you are siding with them and disclosing the names of other contestants to them for possible exploitation an vitiating the election process..

I will request you to take necessary action on the above points to ensure that election process remains totally impartial. I also request you to offer your comments on above points.

Dear Sir,

In accordance with your circular dated 10.04.2011, I have submitted my nomination for the post of President in PARWA EC on 24.04.2011. On 26.04.2011, you have issued a circular after 0800 PM containing the list of names of candidates whose nominations have been accepted by you. I was surprised that the list did not contain my name.

If my nomination has not been accepted by you then it should have been mentioned in the circular along with the reasons for not accepting the nomination. You have also not informed me about this in any separate communication to me. Please inform me without any more delay the reasons for rejecting my nomination along with copies of any documents based on which you have taken the decision to reject my nomination.

My letter dated 26.04.2011 delivered to you in the morning has not been replied by you so far. I had expressed my doubts on the impartiality of election process being conducted by you. As per your circular dated 10.04.2011, list of eligible members to contest and vote was to be displayed by 20.04.2011 but has not been displayed so far. You have not ensured display of the list by outgoing President of PARWA by 20.04.2011. You have failed in your duty to conduct the election in a fair and just manner.

With above rejection of my nomination, I am convinced that you have conspired with outgoing President of PARWA to elect him unopposed by rejecting my nomination.

I will request you to immediately reply my two letters.
